PUBLICATION OF INFORMATION FOR ASSESSMENT ON PRELIMINARY DOCUMENTATION UNDER SECTION 95A(3) OF THE ENVIRONMENT PROTECTION AND BIODIVERSITY CONSERVATION ACT 1999 (EPBC ACT) 


Invitation for public comment

Land Development, James Street and Well Street, East Wanneroo, Elberton Property, WA – EPBC 2021/9106 

Elberton Developments Pty Ltd (the proponent) are proposing the residential development of a 7.48 ha area comprising of 20 James Street and 31 Wells Street, Harris Street road reserve and Wells, Tapping and James Street verges in East Wanneroo, Western Australia (WA). 


The proposed action was determined to be a controlled action on 4 February 2022 under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act), and will be assessed by Preliminary Documentation. The relevant matters protected under Part 3 (s18 and 18A) of the EPBC Act that require assessment are listed threatened species and communities, including: 

  • Carnaby's black cockatoo (Zanda latirostris) – Endangered.

  • Forest red-tailed black cockatoo (Calyptorhynchus banksii naso) – Vulnerable.

Pursuant to Section 95A(3) of the EPBC Act, the proponent invites public comments on the proposed action and the following published material: 

  • Preliminary Documentation Report (EPBC 2021/9106). This includes the original referraldocumentation and associated attachments.

The published material will be made available for public comment from 15 December 2025 to 29 January 2026.
